Data protection
As data controller, Séché Environnement, responsible for the personal data it collects via:
- its institutional website;
- its client portal, Séché Connect; or
- the websites of its subsidiaries;
undertakes to protect the personal data of its clients and potential clients, and any candidates submitting job applications in the “careers” section of its website (together the “Services”).
Séché Environnement undertakes to comply with the laws and regulations applicable to all the forms of data processing that it employs. Séché Environnement undertakes, in particular, to comply with the following rules and precepts:
- Your personal data will be processed lawfully, fairly and in a transparent manner (‘lawfulness, fairness and transparency’).
- Your personal data will be collected for specified, explicit and legitimate purposes, and not further processed in a manner that is incompatible with those purposes (‘purpose limitation‘).
- Your stored personal data will be adequate, relevant and limited to what is necessary for the purposes for which they are processed (‘data minimization’).
- Your personal data will be accurate, kept up to date, and every reasonable step will be taken to ensure that inaccurate personal data, having regard to the purposes for which they are processed, are erased or rectified without delay (‘accuracy’).
Séché Environnement will implement the appropriate technical and organizational measures to ensure a level of security appropriate to the risks inherent in its processing operations, to meet regulatory requirements and protect the data and rights of data subjects through processing operation and procedure design.
Séché Environnement also requires its processors to provide the same level of personal data protection (service providers, suppliers, etc.).

Séché Environnement, a public limited company (société anonyme) with a share capital of 1 571 546.40 euros, listed in the Laval Trade and Companies Register, under number 306 917 535, having its registered office at Les Hêtres, BP 20, 53811 CHANGÉ, is the main controller of your personal data connected with your use of the Services, according to Law No 78-17 of 6 January 1978 (the “ French Data Protection Act”) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “GDPR”).

What personal data do we process?
Personal data means any information identifying you directly (e.g. your first name, last name, email address or telephone number) or indirectly (e.g. your account login or identifier, IP address or cookie identifier).
We only collect and use the personal data necessary for us to carry on our business.
We collect three categories of data:
(a) the data you provide us;
(b) the data we collect by automated means; and
(c) the data we collect from other sources.
We can combine the data you provide us with data collected by automated means or from other sources.
About the personal data that you provide us
You may be called upon to provide us with personal data when:
- you fill in a contact form or request a personal costs quote on our website;
- you open a client account and use the Séché Connect client portal
- you sign up to our newsletters;
- you apply online for a job with us.
In these circumstances, we will need to process the following personal data:
- ID and contact information (first name, last name, employer, job with a firm or company, postal and email addresses, land line and mobile telephone numbers, etc.) needed to provide you with information about our products and services, answer your questions, provide you with a costs quote, and send you newsletters and business communications, etc.
- information required to define and classify your needs, to draft reports of onsite visits, etc., and to ensure the smooth conduct of our precontractual and contractual relationship; and
- your CV, covering letter, professional experience, qualifications, occupational training, current job, etc. when you submit your job application on our website;
Under no circumstances will we ask you for information about your racial or ethnic origins, your political opinions, your religion, your philosophical convictions or union membership.
About the personal data that we collect by automated means
We use automated technologies such as cookies to collect data from your computer or mobile device (telephone or tablet) when you use our online Services.
We collect the following data to enable the smooth operation of our website, safeguard the security of our networks and analyze audience footfall and statistics:
- pages visited;
- your device and connection identifiers (IP address, MAC address), connection dates and times, data about the browser and operating system used, etc., and
- your identification and authentication data, in particular when you use the Séché Connect client portal.
About the personal data that we collect from other sources
Some client data we use may be collected from the following outside sources, for the purpose of checking and expanding our databases:
- data you have made public on the Ministry of Ecological Transition website at https://www.declarationpollution.developpement-durable.gouv.fr when you report your waste (e.g. name of the waster producer, types and quantities of waste);
- data on the ‘Sirene’ National Business Identification Directory, available in open-source on the website at data.gouv.fr.
In addition, to answer calls for tenders or to engage in commercial prospecting, we may need to process the personal data of our potential clients (ID and contact information), collected by our partners in compliance with the applicable data protection regulations.
1. TO PERFORM A CONTRACT ENTERED INTO WITH YOU OR TO PROVIDE YOU WITH PRECONTRACTUAL INFORMATION
We use your data to enter into and perform our contracts, including:

- to manage preparatory identification forms and certificates of acceptance;

2. TO SERVE OUR LEGITIMATE INTERESTS
We use your personal data to establish and develop our products and services, optimize our risk management and defend our interests before the courts, including:

- in the management of our computer systems and their infrastructure (e.g. correspondence platforms) and in ensuring business continuity and individual security;
- for recovery;
- to create statistical models by analyzing your transactions;
- to customize commercial offers: proposing products or services that fit your needs and match your profile, as we define it.

3. TO RESPECT YOUR CHOICE WHEN WE ASK FOR YOUR CONSENT FOR A SPECIFIC TYPE OF PROCESSING
In some cases, consent is required to process your data, for example:

- where the purposes described above result in an automated decision, with legal consequences, and which relate to you or which may affect you significantly, we will inform you separately of the underlying reasons, the importance and the anticipated consequences of this processing;
- if we carry out processing for purposes other than those described in Section 3, we will inform you that we are doing so and, if necessary, will ask you for your consent.

Séché Environnement may collect information about you even if you are not a client of the Group. The list below (although not all-inclusive) contains examples of personal data:

- potential clients; and
- initiators and beneficiaries in tendering procedures.

We do not sell any of your personal data and we only share them according to the terms and conditions set out in this data protection and privacy policy statement.
To achieve the aforementioned purposes, we only disclose your personal data:
- to Séché Environnement Group Entities involved in the supply of the Services;
- to service providers and processors performing services on our behalf (e.g. carriers, website hosts, security and maintenance service providers, fraud management service providers, and technical service providers responsible for sending emails and newsletters, etc.). and
- some regulated professions such as statutory auditors.
We may also decide to sell or transfer all or part of our business. In the event of such a sale or transfer, we may well pass on information that we have collected and stored (including personal data) to any person or entity involved in that transaction.
Lastly, we may be required to share your personal data with any authority, court or other third party where disclosure is required by law, regulation or decision of the court, or if such disclosure is necessary to protect and defend our rights.
We keep your personal data in an active database for the following periods:
- for potential clients: three years from the date the data were collected or from the last time you contacted us (e.g. by clicking on a hypertext link) unless you withdraw your consent before the expiry of this three (3) year period;
- for clients: until the end of our contractual relationship and, in any event, no more than three (3) years from the date of the last time you contacted us;
- for candidates submitting a job application in the ‘careers” section of our website: the time taken in the selection process, and then, for candidates who are not selected, but have consented to their applications being held on file, two (2) years from the date of the last time you contacted us, unless you request the destruction of your candidate file before the expiry of the two (2) year period; and
- for visitors to our website: up to twenty five (25) months.
At the end of the aforementioned periods, some of your personal data will be archived, in an ‘intermediate’ archiving database with restricted access, according to our legal obligations, if needed to defend our rights and interests in court, for the following periods:
- ten (10) years, starting from the financial year end date, for data retained for accounting purposes, and commercial documents (invoices, order forms, commercial correspondence, etc.);
- in any pre-litigation period, until the dispute is amicably settled or, failing which, when any related court action is time-barred under the statute of limitations. For the avoidance of doubt, the standard statute of limitations in civil and commercial matters is five (5) years;
- at the end of litigation, once any ordinary or extraordinary right of opposition or appeal against the court decision has lapsed.
At the end of this additional period, your remaining personal data will be erased fully and finally from our systems or anonymized.
Under the applicable laws and regulations, you have various rights, namely:
- a right of access: you have the right to obtain information about the processing of your personal data and a copy of your personal data;
- a right to rectification: if you consider that your personal data are inaccurate or incomplete, you have the right to require them to be amended accordingly;
- a right to erasure: you have the right to require the erasure of your personal data within the boundaries allowed under the regulations;
- a right to restrict processing: you have the right to restrict the processing of your personal data;
- a right to object: you have the right to object to processing of your personal data, on grounds relating to your particular situation. You have the absolute right to object to processing of your personal data for direct marketing purposes, including profiling related to that direct marketing;
- a right to data portability: where applicable, you have the right to have the personal data provided to us by you returned to you or, where technically possible, the right to have those data transmitted to a third party;
- a right to withdraw your consent: if you have given your consent to the processing of your personal data, you have the right to withdraw that consent at any time;
- lastly, in some circumstances, in particular if you live in France, you have the right to lay down general or specific guidance for the processing of your personal data in the event of death and to change such guidance at any time.
